28th   Dec 2004The case taken up by the Association to resolve the pay anomaly of Civil JTOs who got their first ACP prior to 1-10-2000 and placed in Rs.8570/- IDA scale subsequently is getting cleared. After great effort by the Association the demand to place them in Rs.9850 IDA scale has now been cleared and sent to BSNL Finance.  - Orders expected shortly.

28th   Dec 2004GS continues follow up on EPF, GIS etc.

27th   Dec 2004Association persues further the issues of EPF, GIS and Pension .

(1) EPF - the file processed by DDG (Restructuring) and cleared by Director (HRD) is with BSNL Finance. The Director (Fin) has instructed the Finance section to correlate the issue with the procedures being followed by other PSUs especially NTPC and Oil Sector. We are in touch with the Finance wing and we will be taking lead in collecting the required materials for expediting the case.

(2) GIS - The LIC has submitted a proposal for Group Insurance Scheme for BSNL Employees on the case initiated by DDG (Restructuring). The submitted scheme is under examination. In the meanwhile the Restructuring Section has already elicited our views and is also seeking the opinion of BSNLEU the recognised Non-Executive Union. We are in touch with them so that the views of the Association/Union can be expedited.

 (3) Pension - The issue which had been highlighted by us long back is now being pushed with greater momentum. Coordination of the BSNLEU will also assist us in this matter.

24th   Dec 2004GS meets Director (HRD) and vigorously takes up the issue of the delay in final clearance of the EPF and GIS of JTOs recruited after 1-10-2000. The Director (HRD) then and there instructed the DDG (Per) to persue the case with the BSNL Finance to expedite the clearance by them preferably within a week. 
23rd   Dec 2004Supplementary DPC is likely to be delayed by about a week or so since DDG (SR) , a DPC member is on leave.
Management agrees to increases the size of the DPC (SDE to DE) to 1050. Association will be making further moves to include another 500 odd vacancies.

21st   Dec 2004Massive protest rally comprising over 3000 people led out by SNEA, MTNLEA and BSNLEU from BSNL Corporate Office to Prime Ministers Residence at 1.30 pm on 21st Dec 2004, under the gaze of Electronic and Print media against the move by TRAI and Co. to do away with ADC charges, shakes the streets of Delhi. 10th   Dec 2004GS addresses CMD BSNL conveying the resolution passed by the CWC Kurnool about Association's firm decision to resort to strong agitational programmes if the Management fails to respond to the demands of the Association on promotion on Time Bound basis, service weightage, issues of adhoc DEs, date of effect of IDA pay scales of Civil/Electrical etc. as 1-10-2000. The GS calls upon the CMD to workout appropriate formulae to resolve the crisis and permit the members of the Association to carry on with the job of strengthening BSNL without imposing unilateral and unwanted distraction vitally affecting their career progression. 10th   Dec 2004BSNL decides to file appeal in the Division Bench of Kerala High Court against the verdict of the single bench on the relaxation of paper minima issue. This is as per the advice of the legal section.

GS interacts DDG (Restructuring) who informs that the proposal for Group Insurance Scheme for JTOs recruited after 1-10-2000 has been submitted by the LIC and approved by Director (HRD) and send to Director (Finance) for financial concurrence. After this memo will be prepared for approval by BSNL Board. Proposal for enhancing the ceiling limit for the EPF has also has been approved by Director (HRD) and send for concurrence by Director (Finance).

Date of Implementation of IDA pay scales for Executives of Civil/ Electrical wing - BSNL Finance query regarding the financial repercussions cadre wise has been answered with full details. 

GS meets Sr.DDG (Estt.) and tells him of the CWC decisions to deposit the High Level Committee recommendations for promotion on time bound basis in to the dust bin.

3rd    Dec 2004MAJOR DECISIONS OF KURNOOL CWC.

The CWC has unanimously decided to condemn the recommendations of the High Level Committee outright. Accordingly the following decisions were taken.

 I. PROMOTION ON TIME BOUND BASIS

1. Promotion on Time bound basis as already agreed upon without differentiation or discrimination.

2. The attendant conditions to be totally disbanded. Time Bound Promotion to be implemented on the date of completing the residency period. DPC to consider only special reports and clear all cases without communicated adverse entries.

3. The first promotion on Time bound basis to be implemented with date of effect as 1-10-2000.

4. Since the promotion policy envisages and provides for promotions only on Time bound basis from JTO to SG JAG the question of post- based promotions in that range does not arise. Hence Recruitment of Management Trainees can be considered only beyond the SG JAG level.

II. SERVICE WEIGHTAGE:

Full service weightage to be given for the past service rendered in DOT and all those qualifying for promotions by 1.10.2000 to be given the first promotion on that date itself.

III. ISSUE OF AD-HOC DEs

(1) To place adhoc DEs in STS scale with effect from 1-10-2000

(2) To count the entire service rendered as adhoc DEs while considering the first time bound policy.

IV. CIVIL/ ELECTRICAL ETC.

To effect the date of IDA scale for Executives of Civil and Electrical wing on 1-10-2000 with benefits for considering the same for their first Time Bound Promotion.

V. T. U. ACTIONS:

To authorize the CHQ to serve notice on the above lines and proceed with agitational programmes at the appropriate opportunity.

Comrades all over the country to get themselves prepared for the agitational programmes that is imminent . Leaders and activists to start organising and preparing for launching highly successful agitationprogrammrs.

DECISIONS ON OTHER IMPORTANT ISSUES BY CWC

CWC decided

1) To continue with renewed vigour our efforts to sustain the financial viability of BSNL - Financial losses incurred/likely to be incurred in various fields like AMC of Switches, Outsourcing of CDRs, Outsourcing Bill Printing,  revenue sharing on internet connectivity, GPRS etc will be taken up with the Management for corrective action.

2) EPF, Insurance and Pension cases of JTOs directly recruited after 1-10-2000 is moving at a fast pace. Orders are already existing for enhancing EPF limit to 13.61% of the Basic pay + IDA (Order No.E.No.500-85/FA/IV/KW dated 20/06/2004>>>>>>.Circle Secretaries are requested to take up with the Circle Administration to see that that the order is implemented in the respective Circles.) Cases Insurance Scheme and Pension will be pursued further.

3)Recriutment of JTOs to existing vacancies.

Pressure will be applied to fill up all the existing vacancies in the cadre of JTOs. Attempts by the Administration to limit the size will be resisted. Recruitment notification will be expedited so as to release it by Jan 2005.

4)The draconian orders to levy penal interest @3650% ( 10% per day) will be resisted.

OTHER DECISIONS OF CWC KURNOOL >>>>>>

 

3rd    Dec 2004All India Junior Engineers Association Telecom Civil wing with the General Secretary Com.M.Gunasekharan formally merges with SNEA(I) at Kurnool on 2ndDecember 2004 We warmly welcome all comrades of AIJEA to the Association. AIJEA was apart of the AIBSNLEA until now.

3rd    Dec 2004Supreme Court rule that the Reliance has to pay the penalty due to BSNL within four weeks. The Apex Court asks the Reliance Counsel " What is this big fraud that has been going on about."  The Supreme Court directs the Delhi High Court to dispose of the entire case before 31st January 2005 including the prayer of BSNL that the Delhi High Court has no jurisdiction to decide on this case.

The CWC has authorised the CHQ to proceed with the Court cases related to Reliance Fraud. Accordingly the Association will be proceeding suitably.

KERALA NEWS27th    Nov 2004CEC met at Thrissur on 27-11-2004 to discuss the vital issues concerning the career progression of our members to be taken up in the CWC meeting to be held at Kurnool, Andhra Pradesh on December 1st & 2nd. The Committee after elaborate discussion and deliberations arrived at the following stand to be presented at the CWC meeting.

I. TIME BOUND PROMOTION POLICY (1) Time bound Promotion Policy as agreed upon  without differentiation or discrimination within cadres (2) The attendant conditions to be totally disbanded. Time Bound Promotion to be implemented on the date of completing the residency period. DPC to consider only special reports and clear all cases without communicated adverse entries. (3) The first Time bound promotion with date of effect as 1-10-2000 - Full service weightage to be given for the past service rendered in DOT. However if this is not feasible with minimum two years of service weightage with definite percentage not less than 50% for years completed over two years. (5) To authorize the CHQ to serve notice and to carry on with agitational programmes if and when considered necessary.

II. Management Trainees. - To totally abandon the moves if any to recruit management trainees. In this connection there was unanimous opinion in the committee that the stand of the Association would be extremely beneficial particularly to the comrades of the younger generation and those going to be recruited as JTOs later.

III. Issues of Adhoc DEs. -(1) To place adhoc DEs in Grp 'A' scale with effect from 1-10-2000 (2) To grant two advance increments at the entry stage itself itself with point to point fixation as is done in the case of JAG officers. (3) To count the entire service rendered as adhoc DEs while considering the first time bound policy. (5) To correct the negative increment growth in the presently implemented STS scale..

IV. CIVIL/ ELECTRICAL ETC- To provide notional date of effect of IDA scale for Executives of Civil and Electrical wing as 1-10-2000 with benefits for considering the same for their first Time Bound Promotion.

V. FINANCIAL VIABILITY OF BSNL- Along with the issues that have already been brought to the foreground by the CHQ as well as the other units speedy attention may be devoted  to the directions of the Hon. Minister of Communications & IT  in the recently concluded meeting of the Heads of Circles that all SSAs may be regarded as profit centres. (1) To achieve this goal more decentralisation of powers may be effected. (2) Purchase of materials based on requirements by the SSA rather than the vendor driven system being followed at present to be implemented. (3) SSAs and Circles to be given more power to program and plan the technological aspects based on the profit considerations of the Unit. (4) The losses incurred by unfavourable AMC of switches , outsourcing of CDRs/ bill printing, revenue sharing in the field of Internet (Net one - for planning, purchasing of routers)/ Broad Band area / GPRS etc. to be streamlined at the Circle / SSA level only. (5) Imposition of unnecessary curbs and dumping of materials from the Corporate office level should be dispensed with. (6). Totally uneconomical and forbiddingly costly equipments like DLC without adequate technical supports and not conforming to field requirements to be reconsidered and more cost efficient and utilitarian systems to be introduced. (7) Settle all pending HR issues at all levels with courageous professionalism so that the Executives and other employees can concentrate with undivided attention on discharging their duties more confidently to the advantage of BSNL.  

VI. CASES OF JTOs RECRUITED AFTER 1.10.2000- To pursue with accelerated vigour the EPF, GIS and pension issues of JTOs recruited directly after 1-10-2000.

 

VII. OTHER ITEMS:(1)To scrap the draconian orders on penal interest @ 3650% proposed without codal support on Ty. Advance/ imprest etc and of monumental and unheard of proportions, which would make even ‘Shylock’ faint. (2)To insist for uniform implementation of option to continue in CDA Scales, natural date of increment etc. by interpreting them to the benefit of the employee as intended in and by the orders. (3)To instil a positive and professional culture in Finance Advisors right from the Corporate level to the SSA level so that they desist from their normal negative and delaying tendencies to delay or deny the eligible benefits to the employees citing frivolous reasons or waiting for clarifications on very clear and unambiguous orders. Imposition of penal interest for such negativism to be seriously considered.(4)Consider incorporating these also if required in the next notice for agitation.   

VIII. T. U. ACTIONS: To authorize the CHQ to serve notice and to proceed with agitational programmes if and when considered necessary

KERALA NEWS27th    Nov 2004 JAG and STS officiating promotion orders expected to be released within a day or two on the lines taken by the Association with the Management in its formal meeting held on 29/10/2004.

27th    Nov 2004 Faridabad SSA unit of SNEA organises a grand Seminar on "Adoption of Corporate Culture in BSNL" in connection with Faridabad District Conference and Haryana Circle Executive Committee Meeting. More than 150 Executives attend the session addressed by GS Com.G.L.Jogi, GS MTNLEA Com.V.K.Tomar, AGS Com. Sukhvir Singh, Jt.Secretary (North) Com. K.S.Saini, Circle Secretary Haryana Com. Aravind Pal Dahiya, CGM Haryana Shri. Gokul Singh, GMTD Faridabad Shri. R.C.Hoode. CGMT advocated our members to involve fully in providing better service to customers and being very open accessible and transparent to public. GS Com.G.L.Jogi exhorted our members to bring in a total change in the existing work culture, to be vigilant against the policies of the regulator in favour of private operators. He also requested the Management to settle the pending HR issues immediately so that our members can devote themselves fully to the cause of the BSNL in its stiff  competition with the private operators.

The new set of Office Bearers are President Com.P.Viswanathan, Secretary Com. K.Rajaraja Varma, Treasurer Com. P.V.Mohanan, CEC Member Com.K.Narayanan.

24th    Nov 2004Some malicious propaganda has erupted in some parts of the country on the discrimination of JTOs recruited after 1-10-2000. Association doesn't recognize any differentiation between JTOs recruited before and after 1-10-2000. All JTOs are JTOs and Association shall not allow any discrimination. The reliable information published in our website is the Management's proposal which we have stated will be dumped in the dustbin if and when received in that shape.

KERALA NEWS20th    Nov 2004Annual General Body Meeting of Palakkad SSA held on 20-11-2004 was a highly successful affair with 102 members in attendance. Circle President Com.K.D.Sebatian, Circle Secretary Com.K.Sebastin, Area Secretary ( North) Com. P.Mohanan attended and addressed the meeting. The new set of Office Bearers are President Com.P.Prabhakaran, SDE( TT), Palakkad, Secretary Com. V.P.Sivakumar, SDE (PG), Palakkad, Treasurer Com. M.S.Babita JTO (IN) Palakkad.
18th    Nov 2004GS along with Com. Sukhvir Singh AGS and Circle Secretary Com. Anupam Kaul meet the CMD BSNL and expressed the Associations' strong protest against the secrecy maintained by the Administration on the recommendations on Time Bound Promotion Policy submitted by the High Level Committee. The CMD assures that the copy of the report will be given to the Association.

The case was also discussed with Director (HRD) who assured that the report will be made public after taking a decision in the Management Committee meeting. GS addresses Director (HRD) on this issue.>>>>>

 Director (HRD) was also called upon (1) to expedite the GIS, GPF ceiling and Pension issues of JTOs recruited post 1-10-2000. - Director (HRD) promised that top priority will be accorded to the issue. GS writes to Director (HRD) On this issue >>>>>  (2) In the case of relaxation of paper Minima  for 25% Competitive quota in the light of the Kerala High Court order on the subject . - Director (HRD) has instructed the DDG (Pers) to put up the case. (3) On increasing the size of the DPC for promotion of SDEs to STS  - Director (HRD) has asked the DDG (Pers) to process the case immediately.

13th    Nov 2004Formal merger of All India Junior Engineers Association Telecom Civil Wing in to SNEA will take place at Kurnool. General Secretary Com. Gunasekharan will be leading a delegation of CWC members and Senior Leaders of All India Junior Engineers Association Telecom Civil Wing to Kurnool to finalise the solemn event.

10th    Nov 2004GS addresses CMD BSNL - Immediate Personal intervention requested to ensure that the recommendations of H.P.C under  the Chairmanship of Sr.DDG(E) on time bound promotion policy in violation of the commitments made to Gr B officers at the time of absorption in BSNL are simply brushed aside.>>>>>>>>>>>>>>>

10th    Nov 2004Association has information from reliable sources about the Time Bound Promotion Policy recommended by the High Level Committee. The salient features as available to us are

   (1)Time Bound promotions and Post Bound Promotions are to take place on parallel tracks.

    (2)Residency period recommended for different promotions are

   (i) JTO to SDE     (a) 4 years for JTOs recruited by DOT

                           (b) 6 years for JTOs recruited by BSNL

(ii) SDE to Sr.SDE         - 5 years

(iii) Sr.SDE to DE          - 6 years

(iv) DE to JAG              - 5 years

(v) JAG to SG JAG        - 5 years

(3) The Time Bound promotions are to take place only after stringent attendant conditions on the lines suggested by another organization.(Click here for the Letter No. AIBSNLEA/CHQ/04/111 Dated  05.10.2004 >>>>>)

(4) In the case of Post Bound Promotions Sr.SDE level has been eliminated and promotion will be directly from SDE to STS.

   (5)Service weightage will be available only for the first Time Bound promotion.

   Example:-For promotion from SDE to Sr.SDE residency period is 5 Years. Service already completed in BSNL (after 1-10-2000) – 4 years. All SDEs completing N years (N >1) to one year will all be placed in Sr.SDE scale on the same day.

The Association is prepared to throw the recommendation to the dust bin as soon as the draft is received by it.

10th    Nov 2004Ernakulam High Court dismisses appeal by BSNL in stepping up case by T.Issac and others. The HC goes in detail in to the merit of the case, considering FR22 and substitute FR22 and decides that Senior drawing less pay should be stepped up to the pay scale of the Junior officer even if the promotion of the Junior officer is on officiating basis. Accordingly members facing such anomalous situation should be eligible for stepping up with effect from 30-01-1996.Judgement Copy >>>>>>
